Terms and Conditions
This document outlines the terms and conditions Agreement for the purchase and use of hydraulic components provided by Mayank Hydraulic Seller. By placing an order, the customer Buyer agrees to comply with the following terms.
1. Product Details:
- 1.1 The Seller will supply hydraulic components based on the product descriptions found in our catalogue or provided quotation.
- 1.2 The Buyer is responsible for ensuring that the components purchased are compatible with their specific use case.
2. Installation and Usage:
- 2.1 It is the Buyer's responsibility to handle the installation of hydraulic components. We recommend hiring a qualified professional for proper installation.
- 2.2 The Buyer agrees to follow all applicable safety guidelines, industry standards, and regulations during the installation and operation of the components.
- 2.3 The Seller shall not be held responsible for any damage, malfunction, or loss caused by incorrect installation, maintenance, or use.
3. Oil Cleanliness:
- 3.1 The Buyer acknowledges that maintaining clean hydraulic oil is critical for optimal performance of the components.
- 3.2 The Buyer agrees to take preventative measures, such as using filtration systems and conducting regular oil testing, to avoid oil contamination.
- 3.3 The Seller is not liable for any issues arising from the contamination of hydraulic oil.
4. Temperature Management:
- 4.1 The Buyer is responsible for ensuring that hydraulic oil is kept within the proper temperature range for efficient operation.
- 4.2 Appropriate measures, such as the use of cooling or heating systems, must be in place to maintain the oil at recommended temperatures.
- 4.3 The Seller is not responsible for damages or performance issues related to improper temperature control.
5. Warranty Information:
- 5.1 The Seller offers a warranty on the hydraulic components, subject to the terms stated in the warranty document provided separately.
- 5.2 Any warranty claims will be processed in accordance with the conditions outlined in the warranty policy.
6. Limitation of Liability:
- 6.1 To the extent permitted by law, the Seller shall not be held responsible for any indirect, incidental, or consequential damages arising from the use of the hydraulic components.
- 6.2 The Seller's liability is limited to the original purchase price of the products.
7. Intellectual Property Rights:
- 7.1 The Buyer acknowledges that all intellectual property rights related to the hydraulic components, including but not limited to patents, trademarks, and trade secrets, remain the exclusive property of the Seller.
- 7.2 The Buyer agrees not to replicate, alter, or distribute any intellectual property belonging to the Seller without prior written consent.
8. Governing Law and Dispute Resolution:
- 8.1 This Agreement is governed by the laws of India. Any disputes that arise shall be subject to the exclusive jurisdiction of the courts located in Punjab.
9. Delivery and Ownership Transfer:
- 9.1 The Seller will make reasonable efforts to deliver products within the agreed-upon timeframe, though delivery dates are only estimates and not guaranteed.
- 9.2 The risk of loss or damage to the products transfers to the Buyer once the products have been delivered.
- 9.3 Ownership of the products is transferred to the Buyer once full payment is received by the Seller.
10. Complete Agreement:
- 10.1 This Agreement constitutes the full understanding between the Seller and Buyer regarding the sale and purchase of hydraulic components and supersedes all previous agreements or communications, whether written or oral.
By purchasing hydraulic components from the Seller, the Buyer agrees to the terms and conditions outlined in this Agreement.
